Draft Local Environmental Plan and Draft Development Control Plan

The Draft Tamworth Regional Local Environmental Plan (TRLEP) 2009 and Draft Tamworth Regional Development Control Plan (TRDCP) 2010

A new draft (comprehensive) Local Environmental Plan (LEP) has been prepared for Tamworth Regional Local Government Area in response to the State Government requirements for all NSW Councils to prepare a consolidated LEP, which conforms to the Standard Instrument (Local Environmental Plans) Order 2006, known as the ‘standard LEP template’.

The Draft Plan and the required supporting information was publicly exhibited from 14 July to 25 August 2009.

Proposed Program for the finalisation of the Draft Tamworth Regional LEP

Council, at an Extraordinary Meeting on 7 June 2010, resolved to adopt the Draft TRLEP subject to certain amendments. A copy of the minutes associated with the meeting is available. Council officers have amended the Plan as outlined in the Minutes and submitted the Draft TRLEP to the Department of Planning seeking gazettal of the Draft Plan. It is anticipated the Draft TRLEP will be gazetted in late 2010.

Draft Tamworth Regional Development Control Plan (TRDCP) 2009

In association with the Draft TRLEP, a new Draft Development Control Plan (DCP) was prepared and concurrently exhibited to consolidate all the current DCPs into a single plan, consistent with the requirements of the State Government that all NSW Councils have a single DCP applying to any parcel of land at the time of Gazettal of their comprehensive LEP. That DCP was incomplete and it was planned to undertake further exhibition once the outstanding chapters were finalised.

Draft Tamworth Regional Development Control Plan (TRDCP) 2010

At the time of the first public consultation period, the draft TRDCP contained 35 chapters. Since then, a comprehensive review was undertaken which, while retaining compliance with the statutory requirements, has focussed on:

• opportunities to “fast-track” development by simplifying the process of identifying compliance with development standards;
• removing vague development objectives that can be subject to individual interpretation and inserting specific development outcomes for the range of land uses permitted under the Tamworth Regional Local Environmental Plan;
• removal of any information that could be more suitably located within an information sheet, or is better dealt with by reference to an Australian Standard.

The draft Development Control Plan is being exhibited from 9 August to 9 September 2010. Following the exhibition the Plan will be reviewed by Council with regard to any submissions received.
